1. Agreement to Terms

By accessing or using the services of Media Peak Kreations ("Company", "we", "our", "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Services Description

Media Peak Kreations provides software development services including:

• Professional WordPress website development
• Custom web application development (Angular, React, .NET)
• Desktop application development (.NET, Java, Python)
• Website maintenance and support services
• Hosting and domain setup services
• Technical consulting and architecture advice

3. Project Engagement

3.1 Project Proposals

All projects begin with a consultation and written proposal outlining the scope, timeline, and cost. The proposal becomes binding once signed by both parties.

3.2 Changes to Scope

Changes to the original scope of work may result in additional charges and timeline adjustments. All changes must be agreed upon in writing.

4. Payment Terms

4.1 Fixed-Price Projects

For fixed-price projects (such as WordPress websites), payment terms will be specified in the project proposal. Typically, a deposit is required before work begins, with the remainder due upon completion.

4.2 Hourly Projects

For hourly-based projects, invoices will be sent on a regular basis (weekly or bi-weekly) based on tracked hours. Payment is due within 14 days of invoice date.

4.3 Maintenance Plans

Maintenance plans are billed monthly in advance. Services may be suspended if payment is not received within 7 days of the due date.

5. Intellectual Property

5.1 Client Ownership

Upon full payment, you own the final deliverables created specifically for your project. This includes custom code, designs, and content created by us for your project.

5.2 Third-Party Components

Projects may incorporate third-party software, frameworks, libraries, or assets subject to their own licenses. These remain the property of their respective owners.

5.3 Portfolio Rights

We reserve the right to showcase your project in our portfolio and marketing materials unless otherwise agreed in writing.

6. Client Responsibilities

You agree to:

• Provide timely feedback and approvals
• Supply necessary content, assets, and access credentials
• Ensure you have the right to use all content provided to us
• Make payments according to the agreed schedule
• Communicate clearly and professionally

7. Warranties and Limitations

7.1 Service Warranty

We warrant that services will be performed in a professional and workmanlike manner. Bug fixes and corrections during the warranty period (typically 30 days after project completion) are provided at no charge.

7.2 Limitation of Liability

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Confidentiality

We agree to keep confidential any proprietary information you share with us during the course of our engagement. This obligation continues after the completion of the project.

9. Termination

Either party may terminate the engagement with written notice. Upon termination, you are responsible for payment of all work completed up to the termination date. Completed deliverables will be provided upon full payment.

10. Hosting and Third-Party Services

If we arrange hosting or other third-party services on your behalf, you are responsible for ongoing fees charged by these providers. We are not liable for any service interruptions or issues caused by third-party providers.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where Media Peak Kreations operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify clients of any material changes. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.
